Your Agreement

Nature of Services

Dr. Baird provides health optimization programs and medical services including but not limited to:

Doctor-Patient Relationship & Program Enrollment

Use of this site does not create a doctor-patient relationship unless you are formally enrolled in a program and have executed the appropriate agreements. Enrollment is subject to:

• Completion of required intake forms and health questionnaires
• Medical screening and acceptance by Dr. Baird
• Execution of program-specific agreements and consent forms
• Payment of applicable program fees

Dr. Baird reserves the right to accept or decline any enrollment at his sole discretion.

Telemedicine & Age Restrictions

• Telemedicine services have limitations and may not be appropriate for all health conditions
• You are responsible for ensuring a secure, private environment for virtual consultations
• Technical issues may interrupt virtual consultations — we are not liable for such interruptions
• This site and all services are intended for adults aged 18 and older only

Refund Policy

Due to the immediate delivery of digital content, personalized medical services, and program materials upon enrollment, all sales are generally final. Refunds are only provided in the following circumstances:

• Medical disqualification determined by Dr. Baird before program commencement
• Program cancellation by Dr. Baird
• Technical errors resulting in duplicate charges

If you wish to cancel your enrollment, you must provide written notice. Cancellation does not automatically entitle you to a refund — any requests are evaluated on a case-by-case basis at Dr. Baird's sole discretion.

Cancellation by Dr. Baird

We reserve the right to cancel or suspend your participation in any program at any time if:

• You violate these Terms
• You fail to make required payments
• Your continued participation poses a risk to your health or safety
• You engage in abusive, threatening, or inappropriate behavior toward staff
• Discovery of a clinical situation that cannot be safely managed within our scope

Ownership & Trademarks

All content on this site — including text, graphics, logos, images, videos, protocols, methods, and program materials — is the property of Dr. John R. Baird or his licensors and is protected by copyright, trademark, and other intellectual property laws.

• You may not use any trademark without prior written permission

What You May & May Not Do

You are granted a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes only. You may not:

• Remove or alter any copyright, trademark, or other proprietary notices

Acceptable Use & Account Security

You agree to use the site only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable federal, state, local, or international law or regulation
• Impersonate Dr. Baird, his staff, another user, or any other person
• Engage in conduct that restricts or inhibits anyone's use of the site
• Use the site in any manner that could damage, overburden, or impair it

If you create an account, you are responsible for maintaining the confidentiality of your credentials and all activities under your account. Notify us immediately of any unauthorized use.

External Links & Third-Party Providers

• The site may contain links to third-party websites — we have no control over and assume no responsibility for their content, privacy policies, or practices
• Inclusion of any link does not imply endorsement by Dr. Baird
• We use third-party service providers (payment processing, scheduling, program delivery) who have access to your data only to perform specific tasks on our behalf
• All third-party providers are obligated to maintain the confidentiality of your information

No Warranties & No Guarantee of Results

The site and all content, services, and products are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not warrant or guarantee that any health optimization program will produce specific results. Individual results may vary based on adherence, individual health status, genetics, lifestyle factors, and other variables beyond our control.

Limitation of Liability & Indemnification

To the fullest extent permitted by law, Dr. Baird, his employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the site or services. Our total liability shall not exceed the amount paid by you during the six months prior to the event giving rise to liability.

You agree to defend, indemnify, and hold harmless Dr. Baird and his team from any claims, liabilities, damages, or costs arising from your violation of these Terms, your use of the site, or any harm caused to a third party by your actions.

Informal Resolution, Arbitration & Governing Law

• In the event of a dispute, you agree to first contact us to attempt informal resolution before pursuing any formal action
• If informal resolution fails within 30 days, disputes shall be resolved by binding arbitration under the American Arbitration Association's Commercial Arbitration Rules
• You waive any right to pursue disputes on a class-wide basis or to participate in a class action
• Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights
• These Terms are governed by the laws of the State of Kentucky, without regard to conflict of law provisions

Severability, Waiver, Assignment & Entire Agreement

• Severability — If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect
• Waiver — Our failure to enforce any right or provision is not a waiver of those rights. Any waiver must be in writing and signed by Dr. Baird
• Assignment — You may not assign or transfer these Terms without our prior written consent. We may assign our rights at any time without restriction
• Entire Agreement — These Terms, together with the Privacy Policy and any program-specific agreements, constitute the entire agreement between you and Dr. Baird regarding the use of this site
• Survival — All provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and liability limitations
